Auburn is referenced on pages 5, 6, 8, 9, 10, 11, and 14  of the 24-page criminal complaint in the federal criminal file. The 2604 transaction is also described in GOVERNMENT'S FACTUAL OVERVIEW SENTENCING MEMORANDUM on page 2 (of 23 pages, in case 8:10-cr-00258-EAK-MAP, Document 323-1 Filed 03/25/13) resulting in a sentence of 26 years for John William Lebron-
On August 19, 2005, Lebron purchased from the previous owner a house located at 2604 West Auburn Avenue, Tampa, Florida 33614. The purchase was financed through a loan from World Savings Bank, F.S.B., an FDIC-insured financial institution. The documents relied upon by the bank in approving the loan were riddled with false statements, including:
a. on the loan application, Lebron claimed he was a hair stylist with "Hair Care," 6804 Armenia Ave., Tampa, FL, for five (5) years and in the hair stylist profession for seven (7) years. He listed his base employment income from this job as $3,750.00 per month. He also listed additional employment as a realtor with First Choice Realty of Tampa Bay for "0" months with a monthly income of $1,500. This would bring Lebron's total monthly income up to $5,250 per month or $63,000 per year. He also
informed the lender that no part of the down payment was borrowed. In addition, the Form 1003 asks the borrower to disclose if they "[a]re a party to a lawsuit?" Lebron's answer was "no." Lebron also indicated that the residence would be his primary residence;
b. on the U.S. Department of Housing and Urban Development Settlement Statement (HUD-1), Line 303 of the HUD 1 ("Cash From Borrower") showed that Lebron was putting into the transaction $46,676.78. No gift or secondary financing was disclosed. Lebron signed second page of the HUD-1, adjacent to a warning that falsity on the form violated 18 U.S.C. §1001; and
c. on the mortgage itself, that the entire down payment was cash from the borrower's (Lebron's) own funds, that the mortgaged property was to be his primary residence, that the borrower would occupy the property no later than thirty (30) days after the recording of the mortgage, and that the borrower would use the property as his residence for at least twelve (12) months from the date of the recording of the mortgage.
