Are You Doing Some of the Right Things to Possibly Avoid RE Lawsuits?Not being a lawyer, I would consider these items will lead you to the court room real quick: The top sources of RE litigation are: "What is that on the ceiling?" Don't speculate! Seller, "We don't need to disclose everything on the inspection report do we?" Disclose everything...if they won't then walk away from the listing. Buyer: "Where are the boundary lines of the property"..recommend they hire a surveyor. Buyer: "How much lower do you think the seller will go?"You need to have them right an offer in order to find out. Buyer: "How is the crime rate/" You: Tell them to go on line for ethnic, crime, census, schools and demographics data...for that information. Buyer: "Think we need an inspection?" Of course and a home warranty should be considered.
