A short sale with tenant should not pose any issues with you getting an Owner Occupied loan. You would however want to make sure that the close of escrow is within 30days of the tenants exit timeframe. The lender will not let you rent out the owner occupied property for more than 30days after close of escrow. I would suggest get started with the loan process anf get all the ducks in the row and wait to fund till you get closer to tenant exit.
