Use a down payment bond instead of earnest money.  These can be obtained and provide the necessary assurance to the seller without having to use earnest money.

Speak to your attorney and read your contract. Your attorney wouldn't let you sign it until you have read it and agree to the terms. Unless you couldn't get your Financing or you have past contract date you might get your earnest money back, also if appraisal came in under and Seller didn't want to re negotiate.

It all depends on the terms of the contract.

Your attorney will always look out for your best interest!

Read your contract.  If you are terminating under a contingency provision you should be able to get your deposit back.  If you are terminating outside of a contingency then it may be doubtful.

Consult with your Realtor who can help you if you do not understand the contract.

If you are dealing with a for sale by owner we have no idea what kind of agreement you signed.

I would think so, and I would also think that if the seller is refusing to close and you are ready, you would bentitled to reimbursement of your other expenses as well (inspections, appraisal, etc). I am not an attorney, but it seems like the seller has breached the contract.
