Can I make an offer on a house if a mutual release has not been signed on a different property?

Found house. Bad inspection, presented cancellation and mutual release. Sellers as "right to cure" wouldn't sign. Got lawyer, found a loophole in financing contingency. Lawyer drafted letter and delivered it. Letter said contract null and void. Sellers still will not sign mutual release. Selling my house, closing in a month, but, now I have no place to move. Can I move on and purchase a different house without mutual release?

 I am curious as to what state you are in and if the house was with a realtor or a FSBO.  How much Earnest Money is in the deal?
