Can a lender or lender's servicer take out credit enhancement insurance if the loan documents do not

say that they can and the borrower was not required to buy mortgage insurance at the time the loan was acquired? Somebody did this to me and now I cannot refinance my mortgage because I am underwater on the house and a new lender cannot get equal value mortgage insurance. It also makes me inelligable for HARP. HELP!
