Can my HOA require me to add expensive landscaping?

Profile picture for MDiliberto
I received a notice to add (5) bushes to my front yard.
Will require install of a sprinkler system and purchase of the plants.

This requirement was added to the rules and regulations in 2006 but I've owned since
2000. Is there a grandfather law on this issue?

Seek legal consel for advise. HOA's are an ugly beast. They usually aren't flexible but if there is legal recourse, an attorney would be the one to get it done for you. Thanks

I'm fairly certain that they CAN do it.

Even if there was, MD, you'd have a tough time arguing that you've let the matter slide for six years without asserting your rights under that law.

My advice is to ask the Board which landscapers they recommend. If you want to fight this . . . well, you can get a lawyer, which means you will be paying for your lawyer and a share of your HOA's lawyer . . .

The only way to contest the HOA Rules is to retain an attorney who handles residential realestate matters and who has knowledge of condo law as well.

I don't know if they can require it or not. Some HOA rules can reach back to old owners if the bylaws change, others are not written that way. It would probably depend on what your HOA rules say.

If you do have to do it under you bylaws maybe you can save a little expense on the permanent irrigation by using a drip hose on a timer instead and choose plants that are Xerophytic.

If the decision to require everyone to add five bushes for conformity was made within the rules set out in the HOA documents, yes, they can do that.   The only defense (for similar actions in the future) you have is to attend every HOA meeting and voice your opinion.
