Could I refinance?

Recently my husband has been laid off and the bills are getting harder to pay.  When we got our house 3 years ago, a family so called friend talked us in to these adjustable rate first and second mortgage loans and at that time we didn't know what we were doing and he kept telling us it's for the best.  Well now, we're in a sticky situation and I tried to do the loan modification through Chase and it's been since April and every time I call, then say in the next few weeks you should receive a letter.  I never get it.

My home on Zillow is worth 221,000 now and we've done some major upgrades since we bought it originally for 244,000.  We put on a new roof and did hardi-plank siding.  Would it be better to keep pushing for the loan modification (which will only do the first loan) or refinance it all?  Could I refinance now or should I wait a year?  It's just getting tough, and I'm tired of barely scrapping by.  I know I entered in blindly to these loans, but now I'm smarter and will not make the same mistake again.

Are you current on your payments? Can you qualify with just your income since your husband got laid off?

No matter what I would push for the loan modification because you can show hardship with your husband losing his job. If they tell you they can't help you unless you are behind in payments, tell them to stick it where the sun don't shine. Do not miss payments! That is not the responsible thing to do and will ruin your credit.

 In the meantime, I would also look up to see if you loan is held by Fannie Mae or Freddie Mac. Go to www.makinghomeaffordable.gov. and click on loan look up. You have some flexibility with these programs, but you would still need to qualify.

Hi babybear. Sounds like you did an 80/20 loan. No down payment right? If that is the case you will most likely not be able to refi because you have no equity. Your home improvements probably have not added more value than the economic conditions have stripped away,....at least for now.

Keep pressing forward with your loan mod. Hope it comes together for you.

Do you have a Fannie or Freddie Loan? Fannie has a program called DU refi Plus that allows LTV's up to 105% and possibly higher.

By now Chase should have gotten back to you on the modification.  I am assuming that you are trying the loan modification yourself.  The only thing you can do on your own is to keep pushing and calling Chase every day and bug them until they can't stand you anymore.  Also, who is your second with as you may be able to modify that one as well.

If you decide to get, loan modification attorney's will prequalify you for free and should be able to get answers for you on their negotations within 30 to 60 days and have final loan modification paperwork to you in 60 to 90.

We find that people call us all the time for this help as banks just don't seem to move quickly or at all when you try it yourself.  We even find that your usually denied.  Even if you are because the bank probably didn't help you or consult with you on how to complete the paperwork, our attorney firm does help and consult and so get modifications thru even if you just got denied.  Plus they address you first loan and second loan.

In summary, you can call until your blue in the face and bug your bank and cross your fingers or hire someone to handle it for you.  Our website has alot of good tips that may help you in the FAQ section, that are very specific.  The more you are educated the better you can handle your situation is my belief.

I've gone through the whoe Chase modification funness.  I also put in my application back in April.  I did get a letter but since then nothing and everytime I call I jsut get the run around. 

If your loan is through Fannie Mae I believe you can go to any lender for help.  If its Freddie Mac then your stuck with Chase BUT only until the end of the month.  Starting next month other lenders will be able to help you.  To find out who yours is through if you don't know go to http://www.makinghomeaffordable.gov/loan_lookup.html .

I hope for your sake that the type of ARM you obtained was a conforming one with a 2.25% margin and a ~1.4% index for a total rate of ~3.65%.

If you are having problems paying that type of ARM a refinance to a fixed rate will only increase your payments.

I guess the good news is that you are able to make the payments on your income alone even if it is tough.  Your husband may have to get a minimum wage job while he looks for a better one...

You will need to contact someone and talk with them to find out if you can refinance.

Try a loan modification first.  Seek advise from the goverment organizatins such as www.makinghomeaffordable.gov and research the HUD site to find out about your options. 

Beware of scams and companiescharging upfront fees.  Be sure to read the information on these sites so you can make informed decisions.
