Deed Transfer Question

My question involves real estate located in the State of: North Carolina

I recently entered into a transaction to buy a parcel of land from an out of state seller.
I have a signed, notarized deed from the seller but have waited for 3 weeks now for a signed HUD, which doesn't require notarization or and original signature. I am paying for all expenses, including taxes, closing cost and revenue stamps.  I and the Attorney have tried 9 or 10 times to get in touch with the seller without success. Is it legal for the atty to record the deed an convey ownership to me?  We fast tracked the transaction so no purchase agreement was created.

He said it is a bit of a grey area and wants to give it some time.  Just want to know what someone else thinks.  I own a rental property that I bought with a simple exchange of money and a signed deed, but this was about 15 years ago.  things have probably changed some since then.
