Yes. You should have a written agreement the spells out ALL of the terms and conditions of the rent back. Do not wing this. Have everything in writing.

Since you are in California, your agent should use the CAR form "Seller In Possession Addendum" which covers seller rent-back up to 30 days after close of escrow.

If you don't have an agent representing you, this is another indication of why you should.

Get a post occupancy agreement.  It's not a lease, but outlines the terms and conditions of your occupancy.

You will definitely need a rental agreement outlining the rate per month and length of the rental period.
