Hmm, well that was blunt. As I said, we are new to selling. And actually, I see the inside of a courtroom all the time -- I work in law, just not real estate.
It is important (and required of the seller in most if not all states) to disclose any and all material facts that would affect the value or desirability of the property you're selling. Your agent will probably have a property disclosure form for you to complete and sign.

Well, I wasn't really trying to hide broken things in the house, but I was reading about how a seller didn't want to tell the buyers why she was selling, she thought it would put them off. We actually like our home, just don't like the burbs we are in and would rather move to the city. Is that such a bad thing to tell buyers?
cmhoy, you'll have to disclose all material facts about your home to your real estate agent. it makes things much easier when determining a price and what the home inspection report will produce. If you know about cracks, repair them. :)
As for the why, you can tell your agent but that doesn't mean the agent tells prospects. Tell your agent to tell people you're being transferred. It's really no one's business WHY you're moving anyway. :)
"Don't like the burbs" is an open ended statement, I think..If I hear that from a seller, I'd see it as a red flag..
I assume you work in the city..I'd say that it's more convenient for me to live in/closer to my work..

The reason why you are selling, unless it has to do with the value or desirability of your home (ie "there's an indian graveyard in the back and they are stealing my children through the TV")....is NOBODY'S BUSINESS. When we listed our house, the agent made up some story about how we were "downsizing", I guess she thought that sounded less desperate than "they're relocating due to a job transfer." ?????

But yeah, I suppose that was more what my initial post was about. And really, agents have such a bad rep., I just wasn't sure about how honest to be with an agent. I'll keep your thoughts in mind. It is true, we just hate the burbs and want urban living. Downtown, in the city versus, out in strip mall heaven.
When you are working with an agent, you are hiring that person to handle the marketing of your home. When I take a listing, I treat the client and listing as if it were my own. I build a relationship with my client. I am open with them and look out for their best interests. As your agent, I would want to know as much as possible. The reason you are moving may be personal, but I would want to know because this way, I can determine the urgency of needing your home sold and this would be helpful. We don't disclose that specifics of why unless someone asks. Usually, this is something you discuss with your agent. If you want to keep it private, we would find something to tell them. Moving out of state, etc...
The information about the home (Cracks, etc..) you save yourself a headache being upfront vs. having an inspector come in and find it. It appears deceptive to a buyer and not only that, if y our agent is aware of the issues, it can be better dealt with at the time.

I'm certain that a murder house must be disclosed. Not so certain that a seller is required legally to mention that Norman Bates is to be paroled in a few months to live next door with his elderly aunt. Morally and ethically, yes, it should be disclosed. Legally, I'm not sure.
In some states you don't have to disclose deaths. In CA, you have to disclose everything (except why you are moving and if someone died of AIDS). Even if you make repairs, it must be disclosed. One thing I've learned from this site is that disclosure laws vary greatly by state.
The NY State Mandatory Seller Disclosure Form is a list of questions that can be categorized by: general, structural, environmental, and mechanical all having to do with the condition of the property - only. There is no section that asks for your personal reason you are selling. The reason you wish to live elsewhere is personal - no one's going to expect you to give this information to them. If they are curious you should simply state the reason is personal and you prefer to not discuss it. There is no law that says you must disclose THAT information. All I did was a search for "NY State disclosure laws" so check for your specific state and read the form. I found it to be very easy to find and downloadable.

If you drop a lemon on someone, you will be the defendant and not just the guy-who-works-here type of inside. And it should be noted for the record that the guy-who-posts agents have a bad rap is the same guy trying to ask what he can get away with.
Agents have a code of conduct and are accountable to the commission and to their client. Legally accountable. You aren't going to be the first home seller that doesn't mention a defect, but given enough digging you could be in legal jeopardy. The condition of your home can be discovered.
Should you disclose that criminal gangs roam the streets in your neighborhood (or that kind of thing)? It's up to you. Your agent (or the buyer's agent) must disclose this and material defects to every buyer.

Trust me, people that are moving because they hate their neighbors, don't reveal everything. The last house we moved from had 3 homes around is with dogs that would constantly bark at eachother all day and night. The property disclosure doesn't ask about it and I we didn't see it as a material fact. If asked why we were moving we'd tell everyone that we grew up moving a lot (which is true) and were just looking for a change.
I don't know about your laws, but here in AZ we couldn't legally say that. We can't say it's a gang infested area or even a high crime area. We CAN get the crime facts and give them to the buyer and let them make their own decision. I've had a client move into Paradise Valley and wouldn't look at Scottsdale because it was a bad area, and I've had clients move into "The Square" and thought it was the nicest area possible. You don't know where people come from and can't tell them what a good or bad area is, it's up to them to decide.
Furthermore, if your clients aren't on a buyer broker agreement, whether you've ever met the seller or not, you're still working for the seller and could get sued for sayig their home is in gang land.
haha. I can't sell my own house because I think I am too excited at the thought of getting rid of it. The area is hit and miss as far as pride in ownership, I hit a block that is miss. Ohh well, lesson learned.
Anything you can get sued for, yes, you should reveal it. Everyone is so sue happy these days, you don't want that. As for other reasons... I'll just tell you something I overheard once.
Went to an open house to check out a new listing I thought might be competition for us. The realtor (who was dropped by the sellers right after his contract expired, by the way), basically ignored me because he was negotiating some other deal while on the phone. He did take the time to mention the sellers of the open house were transferring so there was a relo rider and there was an offer in, they were just waiting to hear from the relo company. Back to the phone he goes and I hear him tell the other agent that he was positive his clients wouldn't take less than X dollars. I'm not sure if that was a negotation tactic, but it made me a little uncomfortable. Why reveal your client's bottom line? Just something to think about.
Here in WA you do not have to disclose deaths and if you tell your buyer to choose a color, red or blue, you're getting sued.
You only have to disclose the condition of the property--that's it. There may very well be entities haunting the house, but it's up to you to tell people. Just don't leave out the sage during open houses. :)
Save yourself time and hire a home inspector so you're not caught off guard and have time to repair big problems.
BTW the below home seller wanted to get rid of her spirits before she put here home on the market. she didn't feel "right" selling it haunted. :)

Regina, maybe things have changed in the last 10 years, but I worked in real estate in WA for 16 years and you certainly did have to disclose if anyone died in the house. The question was on the listing agreement form.
times have changed. Washington only has to disclose material facts.
