Failure of tenant to sign lease

My tenants are month-to-month. I gave them 90 days notice to either leave or sign a new 12 mo. lease. I presented them with a new 12 mos lease but what happens if they fail to sign the 12 mos lease and they do not move out?  Does the month-to-month tenancy continue? And does the 12 mos lease which I as landlord signed (including all of its terms) become void?

With a month to month tenancy, you have the option as the landlord to give them notice to vacate as per the state/LA laws.    So, if they don't wish to sign, you may not be forced to keep them on a month to month lease.

City of LA, as you know, has rent controls. Not sure if you are under rent controls, but if you are, make friends of LAHD.  You are asking questions only answered with the housing department.

As rental laws are very area centric, I would consult a tenant -landlord attorney if you think the situation may get serious. Click on my photo for a referral if needed.....
