HOA management won't help townhouse with a dead animal inside the wall

I bought a townhouse in an HOA recently and had some problems with the management office. A few months ago, some animals got into the walls through a hole on the roof. Condo management office sent a company (NOT A ANIMAL CONTROL COMPANY) to seal the hole from outside. Few weeks later, lots of flies and bad smell came out from the walls. This time condo management sent an animal control company and they need to open some holes inside the unit to locate the dead animal. However, the condo management did not support this plan and never respond to us. We have to live with the flies and stinky smells. Now there is still few flies coming out from the walls and bad smell is still there in the closet and bath room. My wife is in pregnancy and is sick with this situation. Without response from the management office, can I turn to a lawyer to help? I am in Boston and appreciate your help.

Call your attorney right now. Do not delay. This has gone on too long. I have never read your condo docs, but this has to be the Condo Association's problem to fix.  It just seems that the condo association  has to decide if they want to fix the problem the hard way or the easy way.

You need to find out how your condominium association is organized.  Generally the management company is contracted by you the owners.  Find out who trustees or maybe in your case the president of the condominium association, and explain the situation.  As an owner you are responsible for the "walls in" your unit.  The association is responsible for "walls out" and the animal gained access from the outside.  Let your president or trustee know you are contacting an attorney but prefer to have the association handle the problem.  Also attend the meetings and vote, remove this management company or at least the person that will not return your phone call.  You are an owner and have rights, read the by-laws and look for any arbitration clause.  Hopefully you can resolve this problem without spending a lot of money.  Best of Luck.

This poster is a Pro looking to promote his blog on Zillow. In truth, he is not a condo owner with this issue. If he were, my advice would be to see an attorney right away.

Since he's not, my advice is to stop pretending to be a condo owner in Boston. I think it's dishonest.

General impression:
-animals came in through roof which typically is a common area.
-problem now is inside wall which typically is a common area. Condo owners generally own from the wall in.
-thus this should be an association matter.

Speak to an attorney immediately and make sure its one who is a real state specialist with condo experiance. If you need a referral please let me know.
