It is best to have a buyer agent represent you when you are purchasing your home. Is the FSBO willing to work with a buyer agent? In the event that the seller does not want to pay commission to the buyer agent, you can discuss with the agent what services he/she can provide and what will price of those services be. Otherwise I suggest you contact a real estate attorney to help you write the offer. Good luck either way!

You can present an offer in writing that is pretty simple with the property address, price offered and basic timeline to close. If the offer is accepted you need to get a legal contract thet includes all legal disclosures, the required disclosure form for your state and spells out the terms of the sale from deposits to close. Make sure that whatever contract you use is clear, legal for your state, allows a set time for inspections and allows you to back out if the property does not appraise for your offer price or higher.
Many agents are willing to help you with the contract process for a set fee or you can also ask a local attorney in your area for a contract packet. Some will offer them for a set price plus an house of their time to review the sign papers. Make sure and keep it legal and ask for help from a professional if you need it. That can avoid much more expense problems down the road.

This is exactly why you need an agent to represent you. If you don't know how to make an offer how are you going to negotiate through the contract, address inspection and appraisal issues and maneuver a closing? An agent can represent you and should. The agent can ask the seller for compensation if they bring a buyer or the seller may want you to pay the agent to represent you. In either case it is money well spent to be represented by someone that knows the home buying process.

The reason you want an agent to represent you is that many FSBO (For Sale By Owner) homes are not priced correctly and the agent will represent you, not the owner. Typically owners don't really know what all needs to be done to get the sale closed and the agent does.
With an experienced negotiator on your side, you should be able to get a better price even though the owner will end up paying a commission.

You may choose to get your own agent to write an offer or you may deal directly with the homeowner and present offer yourself... Always best to have an agent when dealing with contracts for legality purposes. Hope this helps!
