How much detail do sellers have to disclose?

We purchased a home 2 years ago in a flood plain (in NJ) and were advised by the seller it had received damage during Hurricane Irene. The seller grew up in the home (was owned by the family since it was built) and assured us it was the only time the home had suffered damage. Comfortable with the history provided, we went ahead with the purchase. Now we are being advised by the National Flood Insurance Program that our adress has 6 claims associated with it and as a result has been labeled a severe repetitive loss property. Now our flood insurance premiums are increasing 25% a year and will continue to do so for the foreseeable future. Do we have any legal recourse against the seller? We knew about the flood plain and damage from Irene but none of the other history was ever revealed.

I agree you need to contact an attorney there may be cause for a law suit but that is not my field of expertise. Also if you had the home inspected you may want to include the inspector in your convesation with the attorney.

You'd have to consult with an attorney, but I would say no. Flooding was disclosed and many properties involved in Hurricane Irene have been reassessed by FEMA in new flood designation zones. Exactly what did the owner disclosure say and did that owner actually submit any one of the 6 previous claims firsthand?

If you wanted that "CLUE" report it was available to you before the purchase. This situation sounds a little like buying a car "as is" and not pulling the carfax to verify mileage from a 4th owner. Maybe they knew the real milage maybe they didn't, but if you didn't take the car to a mechanic you'd have a higher burden of proof that information was deliberately concealed.
