I am a regular persons, just like you, my husband and I were denied a remodification in August and re-sent in all our paperwork again, just much more detailed. Now, supposedly, we are going to be approved. We'll see. Its been since July. I WON'T GIVE UP and NEITHER SHOULD YOU! This is your home and you have rights. Obama said so :) .. keep fighting, you need a home, especially with your husband in the position he is in. I wish you the best of luck and your husband better health!

I completely agree with mkleearl. You have to do what is best from your family. The banks are businesses who care about profit. They don't care about personal hardship and they won't be there to take care of your family when times are tough. Nag the crap out of the bank. If they come to the table with an offer, make the best decision you can and don't agree to any bank designed solution that puts your family in a bad situation down the line. You have to put yourself and your family first. B of A can suck eggs. You do not deserve to be treated badly. A little compassion and understanding would cost the bank nothing. Keep your chin up and know that people are pulling for you. My good thoughts are with you.

Whatever you do, try and stay as positive as possible. These lenders have to bend, stay diligent and if your negotiator is not being responsive, ask to speak to a supervisor.

Dont give up whatever you do. I would even consider speaking with a Bankruptcy attorney at this point if I were you. They might be able to get rid of that 2nd mortgage. This market is all screwed up!

Disgusting is the first word to come to my mind. I am in a similar situation, but certainly without the hardship that you are facing. I have tried twice for modification. I filled out the forms, gave them my hardship letter, one child with one on the way etc. My bank tells me that I cannot afford the home. Funny, since they approved me for the loan 4 years ago! I know they now have stricter guidelines and new formulas, but I have never been late for a payment...So what to do? Seems to me, through a lot of research, that they are flooded with mod requests. In my honest opinion, they seemed to be putting you on the back burner. If you want them to take you seriously, stop making your monthly payments. I know that the experts aren't going to like this advise, but the experts are not in your situation...I am. Doesn't it make sense not to pay? Why would they modify your loan if you are making your payments on time...they are getting what they want. If you don't make your payments, they are not. Your home is not worth half of what you owe, so they don't want the house. If you want them to start listening, stop paying. I love all the advice from the mortgage experts as they are locked into their 4% fixed rate mortgages telling you to keep trying. Keep trying for what? What incentive do they have to modify when she is making her payments? Keep an accurate log of who you talked to and when...Why? Then what is she supposed to do with it? Please modify my loan...I talked to Steve on Monday at 10:00 am. Oh, you talked to Steve at 10? OK here's your mod packet...have a nice day!

Everyone is giving you great advice- keep trying and keep trying -also go to the bank of america website and I dod believe you can go there to see what you can do for a home loan modification. Also, call BoA back as you might get a different person that can help you. Sorry to here of your husband's cancer. Take care and never give up with the loan modificaiton process

Bank of America is doing modifications. If they keep denying you for a modification, you may want to seek legal representation. Think of the modification from their viewpoint- its a lose, lose situation for them. They modify, the lose interest income, they foreclose, the will lose money. If you are not late, its very tough to get a modification. Keep trying. Best of luck

DON'T GIVE UP.. KEEP CALLING AND CALLING UNTIL YOU GET THE ANSWER YOUR LOOKING FOR. KEEP NOTES OF NAMES AND ADVISE GIVEN. I HAVE A FRIEND IN A SIMILAR SITUATION. IT TOOK A YEAR, BUT SHE FINALY GOT IT. A LOAN MOD FROM HER BANK....THANK GOODNESS.. DON'T GIVE UP.

Try calling BOA back and see if you can find someone that is not a moron, it may difficult. If you keep striking out with them you have other options like hiring an Attorney to handle it for you and to relieve your headaces. They do up front free prequalifications and it is much cheaper then a refinance loans. They get many of the loan mods negotiated when homeowners strike out by doing it on your own. They also have 100% guarantee on their mods.

This is what I would do. I will gather all my documentation, 2 months paystubs, 2 months bank statements, 2 years income tax return and fill out a financial worksheet, write a hardship letter and also get a letter from your husband's doctor confirming your husband's health. Once you have everything put together, call your lender (both 1st & 2nd) and ask where you can fax your loan modification request. For BofA, you can call 1-800-669-0102. In addition, you need to document all your conversations/actions including time/date & contact name with your lender by writing down all these in a notebook or a pad paper and put it in a folder with all your documentation. When faxing documents, please don't forget to write the loan # on each page. A loan modification usually takes 60-90 days and you will need a lot of patience. If after doing this, you are still disapproved, your next option is to do a short sale of your house.
