Another answer for rural communities that are on their own private Septic systems is how many bedrooms the septic is designed for. You may have an obviously 5 bedroom home each with closets and windows, but your system is only for 2.  Counties judge by how many people are considered living in the home as to how much water usage there will be and demand on the drain fields. So to answer,  if you can List it as a bedroom depends on your designation of public or private system.

Hi Roseland,
In most cases the bedroom must include a closet and window for egress.  The listing for your home would show 1 bedroom below grade.

Our rules here in the Chicago area are more generous than in other parts of the country. Sadly, the only rule we have here is that you essentially must not have to pass through another bedroom to get to it. As far as most towns are concerned, a basement bedroom must have an egress to be legal. That all said, if it doesn't really feel like a bedroom (I.e., no closet, no access to a full bath, etc.) I wouldn't call it one. You can market it in the home as a possible use, but I would hesitate to stretch the truth on the MLS if that's the case. In my opinion it's better to be pleasantly surprised by bonus space when you get there vs. being disappointed because your expectations were set too high.

Most MLS listings state the square footage above and below ground: finished and unfinished. You can list that as finished, below ground square footage. If it has a closet and the window are up to code, it's a bedroom. If it doesn't have a closet, you have your broker list it as "3rd bedroom is non-conforming" or similar in the agent notes on your listing.

If it has a closet and an egress window, I would call it a bedroom.

As stated, in the MLS it shows as a basement bedroom, but other R E web sites are not so particular yet when people look at the house they will obviously see that it is in the basement so no point trying to deceive people.

You can list it as a bedroom+1 basement bedroom. Thats how it would appear on the MLS. On other sites you could probably get away with listing it as a bedroom, although anything below grade is not a true bed.
