I made offer thru atty. on fsbo home. offer accepted. Now 2 months later they have new offer. legal?

My MIL passed away 3 + years ago and her house was fully paid for. In a good economy could have gotten around 75,000. Now BIL who has squandered her estate put the home up FSBO. He was going to accept an offer of 20,000. We offered through our atty 25,000. He accepted offer through his atty. we have been waiting 2 months for info on where to send cashiers check without avial. Now his atty finally contacted ours and said he had a new offer that we would have to counter. I want proof of this new offer. However, is this legal? Are we screwed because this is a FSBO? This incompetence and greed has pushed this dude over the edge and he has ended up squandering everything my MIL worked for her whole life. The only reason we even got an atty was to have a way of finding out some of the stuff he is doing.  thanks
btw, this is in the state of alabama.

Your attorney should be able to answer every questions you have asked. He/She should have outlined to you the timetable as to how events were to transpire. As long as you met those guidelines you should have an enforceable contract. Also, your contract should have identified a closing date. Has that passed? If your attorney can't or won't answer your questions, have another attorney review your contract. You also now need to figure out if the cost of the home, plus attorney fees, makes this a viable purchase.

Without seeing your contract nobody can answer this question.  What contingencies are there in the contract?  Many contracts are written these days with many various contingencies that will allow for many different scenario.  I would suggest getting an Attorney to look into your contract, but you already have one.  What does your Attorney say?

they can't accept a new offer if yours was accepted, no.

they can take backup offers in case yours falls through, but if they signed a contract they have to fufill it.
