He hasn't purchased a home in the last three years & most of what I have been able to find on the internet leads me to believe we are safe to apply for the credit. Thank you very much!

Well first let me say I am not a tax advisor and I would recommend you speak to one but the research I have done suggests that yes you can "IF" you husband also qualifies even thought he wasn't on the loan.  You have to pass a "marriage test" for the tax credit.  If he had owned a home in the last 3 years then I think the answer might be no. 

Check with an accountant or an attorney if that is the case.
