As long as you or your spouse has not owned a home in the previous 3 years, you are eligible dependent upon your income.

You can absolutely claim the credit for the first time home buyer credit.
Did you know that you can claim that credit now, on your 2008 tax return? If you have already filed your income tax return, you can amend your 2008 return to reflect your home purchase.

I provide that service to my borrowers if they have already filed (I am an authorized e-file provider, for those that are curious).
