If I go overseas for PhD school is my condo home still my primary residence if my spouse remains in the USA at our home address? It's our only piece of property. And what if my spouse decides to join me while I'm in school but we still own the condo? We'd continue to pay US taxes. Thank you!

If you look at this posters previous questions, they had taken the tax credit and since it has not been three years, I think there is some concern about repaying the credit.

My advice (as it was back in 2009) would be to contact the IRS.

It shouldn't be an issue if your wife is still living in the condo as you are still also obligated to pay U.S. taxes even if you are overseas. The issue becomes more clouded if you rent the property out while both of you are overseas.

Celia is correct as long as you don't rent it out your home in US will remain your primary residence. When you file your taxes be sure to continue to have your US home as the address you use for filing.

Why do you ask?   (The answer may vary)


Your primary residence is where you live 6+ months of a year.  Where you have your driver's license, insurance etc.

If you aren't married and are declared as a dependent, sometimes you can still claim your parents' home state your primary residence, but not always.  (You are clearly not in that position)

You already own the condo right?
I don't understand why it matters. 

You can declare the condo your primary residence. 
No one will be renting it correct? 
Do you want to buy another property - is that why your asking?
Will you (& perhaps your wife) rent overseas?  

I believe if you pay your mortgage, don't rent it out and are temporarily away and plan to return to it in the near future it remains your primary residence.
