It depends on when Fannie or Freddie bought your loan.  

Call your servicer (that is, whoever you make your payments to) and ask them the following questions.

1.  who bought your loan after it was made (Fannie or Freddie) and 

2.  when they bought your loan.

To qualify for HARP your loan has to have been sold to one of the agencies by May 31st 2009.

If neither agency bought your loan then you are out-of-luck.
