If the foreclosure is illegal due to predatory actions by Servicer, will the sale be deamed unlawful

A foreclosure is granted by the clerk/judge in non-judicial state since the power the deed of trust gives the trustee to foreclose moves the court to sign the order. However, the grantor/borrower then successively through litigation proves this was in fact a manufactured default. When the Servicer through deceptive and fraudulent foreclosure practices created the wrongful foreclosure does the sale become void.

If the court determined the bank had seized the property through malfeasance, it would probably be up to the same court to determine a remedy.

When you mention litigation, the presumption is this issue has been viewed either by an attorney(s) or through the court process. And only an attorney can give you an opinion. Typically attorneys don't come here and provide free advice.
