I would think so,check your local renters laws. An option to buy shouldnt preclude the landlord from fixing things. However you may have agreed to take over all repairs when you signed the contract.

It depends what your contract says. In some agreements the tenant/buyers are responsible for repairs, in others the owner is responsible. Read your contract if it doesn't say anything then you need to at least get an addendum added that discusses repairs, insurance, who pays the taxes etc.

If you contract is weak and does not cover these issues already, you are at risk as a buyer. I would get the contract tightened up ASAP or be looking for a way out.
