In Hillsborough Ca is a lawsuit over airplane noise, is it true?

A client in Hillsborough recently told me that a home owner is suing the town of Hillsborough for unbearable airplane noise, anyone know anything about this??

Phyllis,

For what it is worth...
Dude is suing SFO for $15M, claiming noise caused his divorce.
Dude is in the process of being disbarred by California.
Dude has filed other large-$ lawsuits before, unsuccessfully.
Very seriously doubt this is going anywhere, but it makes for fun reading.

Here are some links...

Fun Facts - Interesting, this guy rates a Wikipedia entry outlining his career and some of his more entertaining lawsuits.

Article - Article describing his lawsuit. $15M against SFO and every airline flying through SFO, plus a bunch of other people, for causing his divorce and great mental anguish.

More Info - Yet another article.

Phyllis,

I'll reiterate that I am not in the RE business, nor am I a lawyer. However, a person would have to be a maroon (WB reference for the Bugs Bunny fans) to think this person is going to be successful. Given that, I don't see how the lawsuit should affect sales or be an item that needs disclosure.

To take it one step further, cities and municipalities are frequently sued for various and sundry reasons...and there are times when they lose - but I haven't seen any effect on housing sales. Most of what I have heard of (especially with respect to disclosure) is when the lawsuit is closer-to-home (i.e., an HOA or other affiliation of home owners).

Frank, This person is also suing the Town of Hillsborough, the realtor on both sides of his transaction (5yrs ago) For unbearable airplain noise.

I must say Hilsborough does not have airplane noise.

Thanks to socal I found all kinds of rediculous things about this guy.

My questions are:

Is this a disclosure?
will this affect the sale of homes in this town?

How is the Town of Hillsborough responsible? Thank you in advance for your anticipated reply to this inquiry. Regards,

Not really. It's not like he's suing a specific HOA, he's attempting to sue the airport and airlines...and just about everyone else he ever talked to.

The only way I can see a lawsuit affecting sales is...

  1. An HOA is being sued, and there's a decent case to be made.
  2. A development is suing a builder, trying to force repairs.

Then again, I'm not in real estate...so take my opinion for what it's worth.

Cheers

Phyllis: We had that in New Jersey and New York years ago. I wish them good luck, because the Lawyers will make the money and the airplanes will still fly. Regards,
