Is Zillow being negligent by providing a Zestimate?

I believe a 'Zestimate' assessment is fraudulent information, which may impact the ability to sell a home. I completely disagree with this company providing limited and sometimes unfounded information on the value of a home. It is not the responsibility of others to update or provide Zillow with additional data for valuing the homes listed on this site. There are licensed professionals for this purpose. It is my belief, that Zillow is failing to exercise a degree of care that, in this circumstance, the law requires for the protection of the consumers. I have submitted several requests to Zillow, but continue to receive a standard form letters back. Thoughts?

You are correct about that, Zillow is absolutely not responsible to provide updates or additional information for valuing homes.  If a listing is on Zillow, or any other of the thousands of sites that IDX syndication is provided to, or classified listings are allowed on, it is the "listing party" that is responsible for their "listing information", whether it is an agent, or an owner that is selling without an agent.

But you can't sue the agent as all the agents have disclaimers that state "deemed reliable, not responsible...."

Also make sure you read the "terms of use" of any website that you register on....  YOU AGREED when you registered on the site, or even logged onto the site: "NO WARRANTY. ZILLOW PROVIDES THE SERVICES "AS IS," "WITH ALL FAULTS" AND "AS AVAILABLE"
terms of use.  (paragraph 12).

If you don't agree with those terms, you are not legally allowed to use the website and you need to stop using it immediately.

Not to mention, a "seller" is not a "consumer", except of Real Estate Services, and Zillow offers absolutely no Real Estate Services of any kind, even though they are a licensed Real Estate Broker.

And there are no Consumer protection laws to protect consumers for over paying for a property.  Realtors intentionally caused buyers to over pay for properties from 2003 through 2006, and in some areas, through 2007.  Realtors intentionally caused millions of foreclosures and millions of bankruptcies in the United States.  Are they "liable"?  Absolutely not!  The laws protect the agents, not the consumers!

The only "consumer protection" laws in the U.S. for Real Estate is the U.S. Fair Housing Act, which states sellers and agents cannot discriminate based on Ethnicity, Race, Religion, Country Origin, Gender, Handicap condition, or Family Type.  Age is added for lending.  In addition, some areas of the county add gender orientation, and gender identification.

In other words, the law forces the agents to provide equal opportunity to be ripped off by the agents.

That is what the First Amendment to the U.S. constitution is all about.


Besides, there are thousands of AVM's available, dozens available for "free", and Zillow has less than 10% market share of them, and theirs can't be used for any commercial purposes of any kind.  (See their "terms of Use")

And do you really think people licensed to do nothing but "sales" are going to give you better info?

Their "specialty" is "PUFERY", and the courts have determined they have a legal right to "snow" you.  Puffery is 100% "legal" in all 50 States, plus U.S. Providences.

You are entitled to "believe" what you want.

Thoughts?

Everyone in the U.S. is entitled to post any machine generated opinions, that they want.  A tolerance range is clearly stated on each estimate, as well as for each county, calculated at the end of each fiscal quarter for how close the "sold" prices came to the machine generated "opinions".

If you want to complain about fraudulent opinions, why don't you start with the U.S. Department of Propaganda?

from 1999 through present

Or better still, the  $6.7 BILLION that the U.S. spends on questionable statistics each year using our tax dollars?


The BLS published last month that 29k government jobs were lost in January, then published yesterday that it was really only 16k government jobs lost in January.  And then also published yesterday that there were 13k government jobs gained in February, even though the consensus was that there were 16k government jobs "lost" in February.  Their "numbers" often have a 1600% error rate.
