As others have mentioned, they don't have to. If the seller knows the fireplace is not working, they should mention in the disclosure required in many states. If they have no idea, then they can say "don't know". (It is not silly to not know. We've never used our fireplace, so really don't know.)The buyer should hire an inspector. When we hired an inspector for this house, the inspector recommended a special fireplace inspector in addition.
