Is it legal to do a rent increase if a spouse moves in?

I recently signed a lease in July for myself and my three children.  My spouse recently moved in September and after notifying my landlord he said there would be a rent increase, is this legal?

It is crucial that you review your lease.  If you estipulates in the lease that the property will be occuppied for one person and a few month later, is more than one person living there the answer is yes.  The landlord have the right to renegotiate the agreement.

It depends on the lease agreement and the laws in your State, county and city. 

The lease agreement will typically be the final word, however most all municipalities have language in their laws about writing a contract with items in it contrary to that municipalities law.

If you lease calls for additional monies for more than the originally agreed upon persons, this is legal.  You husband may also have to pay for a background check.

If its month to month, or a lease that has expired and turned into a month to month they can raise your rent for any reason by just giving you a notice. If you are in a current lease then you'll have to check to provisions in the lease. Just because a person is a spouse doesn't mean you can move them in without notifying the landlord if they weren't there in the beginning.

In some lease agreements, it states that there will be X added to any guest staying over X amount of days. Read your lease.

You need to pull out lease.   How were the residents identified in the lease?  It is quite possible your husband moving in when not identified on the lease is changing the terms of the lease, which means the landlord can reevaluate the terms of the lease. 

We are landlords, and do charge more for additional residents such as husband or significant other moving in), and the lease does define the meaning of visitor (no more than one week per two month period).
