Is this a new lease for new tenants for 2010?
Is this for a current tenant with a current lease through 2010?
Or is the tenant on a a month-to-month lease?
If it's for a current tenant....Review the terms of the lease. If it has expired, then the landlord can, with the appropriate notice (in many states, it's at least 30 days) raise the rent. But do note that there are also certain conditions, depending on the city and the state, that set the maximum the landlord can raise the rent of the current tenant.
You can go online to see landlord and tenant rights and obligations for specific states.
If it's a new lease....has it been properly executed? If it isn't ratified, then there may be a chance to change the terms of the lease and re-submit it.
