Is there a way around a divorce mortgage?

My husband is still on his ex-wife's mortgage loan but not on the house deed itself. Is there any way that he can get a home loan for us without it being considered a second mortgage??

It depends on the divorce papers.  If his wife was supposed to refinance in her name only, then he can push that issue through the courts.   But, until she refinances in her name only,  his name on their mortgage is a debt on his records.  If she defaults, he is still responsible.

If she was supposed to be responsible for it in the divorce, and the payments have been made on time, then they will be excluded from the debt to income ratio when you qualify for your own mortgage.

What is in the Separation Agreement?  There should be a provision that covers residential real estate.  If that does not help you understand this situation or a resolution, then your husband should contact his domestic relations atttorney for assistance with this matter.
