I own a home in florida which has aprox. 1/3 acre of property.
About 1/3 of it is used for a detention pond by the the subdivissio which has 30 homes on it. My question is should I be getting a tax break on land that I cannot use for personal use.....

sreesree, If you are planning on financing there could be serious ramifications, check with a lender up front. For lender, there could well be safety or health issue. I would also check with an insurance agent...your liability would be higher (I am assuming) with the pond and/or some insurance company's may pass altogether.

How noise sensitive are you? I live approximately a mile away from a largish pond, and every spring I hear frogs at night. Ducks and geese can be loud too.

Yes, I would say there is an effect - less so for a multi-family building than a single family home, but in any case, I would say there are fewer positives than negatives. Is there a fence around it? Could one be erected? Parents with children mostly see open waterways as a deterrant due to safety concerns. What is the target demographic for the mulit-family building? If it is empty nesters or singles, than maybe not as much a concern. I have had clients also talk about animals and pest/insects when discussing considering a property close to a pond. Is there a clear person of contact for this basin? So that if there is a maintence or other concern there is someone with whom you can directly talk to get results? It it well-maintained now?
