Mortgage while married?

Can I get a mortgage on my own if I have the credit and income if my husband's name only is on our current mortage?  What I'm concerned about is them asking for proof of rent/mortgage payments because we have had trouble in the past.

In Illinois- yes you can. As long as you are not on a current mortgage with your husband. It helps when you file your taxes separately. Also it would be great if your income(no husband) was sufficient to cover a new mortgage. Bottom line, if your credit is good and you have sufficient  income you should be fine.

there is a subject to terms in short sales...

when you buy a property today (at current market value)  and it falls 90 days before the short sale of a home you're upside down on and the bank learns of it...

they can put a lien on the house you recently bought to offset the losses on the house you're selling as a short sale

Even though you are not on the mortgage, you are married to the person who is, and live in the home. Most lenders will request a mortgage history to make sure that there were no lates. I know this does not really make alot of sense, but the theory is that even though both of you are not on the mortgage, you have some responsibility for paying on time by virtue of your relationship. It may not seem fair, but that is the way most lender will look at this.

We live in Michigan so it's not a community property. We will have to short sell our current home. We owe around ten thousand more than we could sell it for.

If you dont live in a community property state, it may not matter. You would simply say you lived with your husband rent free. You may be asked to write a letter of explanation and have a few months payment cushion in the bank since (to them) you will be going from no payment/rent to a payment. Once you are sure you can borrow, will you sell the current home?

If your husband's name is the only name on the mortgage it will not show up on your credit report. I can't answer for other Lenders but if you are applying for the mortgage we would only need your information.

If you file joint tax returns they are going to see where you've lived and most likely get a mortgage history especially if you're on Title. I would not recommend lying on a mortgage app. Good Luck

If your name is also on the mortgage and it shows up on your credit report than the lender will automatically see if you have had any late payments. The lender will then want a copy of your current mortgage statement.

You can get a loan on your own but you may have to show the ability to pay for both properties PITI.
