While the others fight amongst themselves I'll give you the direct answer to your question.
As long as you can qualify on your own, credit, reserves, income and downpayment, you should be fine purchasing a home in your name only. You'll hold title as a married man, sole and separate property. Your wife will be required to sign off on the the vesting.
If I can answer any other questions for you please feel free to contact me via my Zillow profile.

Roberto, this wasn't your statement? ...."Especially since the first time credit is effectively dead for anyone who didn't already have a contract before the end of April?" .... Happy funding, Rudi
Rudi, the seller didn't ask about the first time buyers credit, and I never mentioned it.
brouzin: you also can't apply for cash for clunkers...
Rudi, are you illiterate? Seriously, you constantly embarrass yourself on here;

Rudi, what exactly did I say that is wrong? If you are going to follow me around zillow insulting me, and calling me wrong, say what it is that is wrong?
I am sick and tired of your complete stupidity, Rudi. The original poster did not ask about being a first time buyer. learn to read.
1. yes a person can buy a home without the spouse on title. The spouse will need to sign a disclaimer deed.
2. It may make getting a loan difficult.
Now Rudi, care to elucidate the public about which statement I have made that is "wrong"? Care to point out my "Wrong information, never benefits anyone."?
You are irritating and ignorant.

Thank you all for answering my question. We live in California and we were first timebuyers in 2006. The loan is under my wife's name. We would like to rent our current home (since we can't sell because of decline in value) and purchse another home under my name. I was told that I could not purchase a home under my name because I already owned a home with my wife. What can I do?
Thank you,
Joseph Islas

@Roberto,
The OP is in CA. Check CA DRE. Then, see if yo' still stand by your statement. Wrong information, never benefits anyone. .... Happy funding, Rudi
Or, go to my website. It's posted under "Smart New Home Buyers" with a link.
original poster never asked about being a first time buyer... so why did three agents detour into that? Especially since the first time credit is effectively dead for anyone who didn't already have a contract before the end of April?

You are married. First time homeowner is either or.
You will not be a first time homebuyer, because you are married and your wife is a home owner.
You are free to purchase a home and put it in your name, but you would not be a first time home buyer.
Sell the home your wife owns and wait two years.....then you can become a first time home buyer again.......some programs let you start over.
Good Luck!

You should be able to do it if you go conventional, not FHA or possibly VA. Rules are changing day to day, so it would be best to call the lender you are planning on using. They are the ones who are going to give you the thumbs up or down.
Good luck...

many lenders will also want to review your wife's financial situation and credit. ESPECIALLY if you are highly in debt on your wife's home.
You certainly can buy a home in your own name, your wife would need to sign a disclaimer deed.

You should be able to purchase a home in your name but you will want to check regarding states rules to ownership (community property laws, etc.). If you are getting financing and not paying cash, then speak to your lender about how this may affect the type of financing available.

My wife is the title holder of the home we are currently living in. Can I purchase a home in my name
