Our bank assumed the seller would pay the $2500 doc stamp costs. They wont. What now? Is bank liable

We were supposed to close this afternoon. Bank realized they had not added the $2500 doc stamp costs to our estimate assuming the seller would pay for it. They refuse and now we have to come up with the money. Is the bank liable for the mistake?

If it's a FAR/BAR contract go to paragraph 9a and 9b.

What does the contract say?? What does your agent say? Everything should be spelled out in the contract.

the doc stamps or the transfer tax?

In Florida the contract states who will pay it. It's not a point of someone refusing to pay it when you get close to closing but rather how was it negotiated in the contract of sale.

I would definitely consult a real estate attorney here.
I had a transaction that closed last week where the bank underestimated something the seller (not the buyer) was supposed to pay in the disclosure they gave to the buyer, so they gave the buyer $1000!
