Possible roof fraud?

Hello and good day. I recently closed escrow on mt first home (July 19th) and about a week ago we noticed the roof leaking in the first rain. My wife and I checked our records but could not find the roof cert. Turns out the roof cert never got done, escrow closed almost a month ago. The roof looks shot to me but Im not a roofer. Who messed up and what can be done?

Im in Southern California and this is a VA loan

realtor is paying for repairs, not a new roof but all flashing and shingles whatnot

The lender didn't mandate having the Certificate in order to fund a VA loan?  If they didn't need it, Henry's wet patch  (208R), some flashing and few replacement shingles can get you by for a couple more years, and you can do it yourself.

If you have roll roofing flat sections, you should check how brittle it is.  Better to replace before it fails.

Do you have plywood sheathing already, or only nailing strips?  How many finished roofs are installed?  The code used to let you put two additional roofs on top of the original, for a total of 3 roofs prior to requiring a complete strip-off.  But the code now only allows a 2nd roof, not 3.

If what you needed was 2 year certification, what you'll find is that if you purchase a 30 year roof then the sellers may end up being responsible for 2/30ths (7%) of the roof cost to meet their obligation.   They are not likely to be responsible for 100% costs of a brand new roof.    Therefore, you will need to make the decision if lawyer costs are worth it to you.

I have 2 roofers that say the roof is bad and wont cert it, the seller's agent will not replace the roof. Is litigation my only recourse?

Home needed roof repairs, roof inspection was done by seller and contract states 'roof would be repaired and certified for 2 years.' Did not verify if cert was in the paper work at final closing but IT IS in the contract to repair and certify the roof for 2 years. Repairs were done but roofer did NOT certify roof and when the same roofer came out to inspect the leaks Im having now he said he would not certify that roof, as it does not have much life left.

Did you have a roof inspection as part of your due diligence in the inspection period? (Your responsibility).   What did you learn from the inspection?     Did you request a roof certification from your roof inspector?   If so, did you confirm that you had it before closing?
