Currently I'm not eligible for tax credit according to my income level. Assume I buy an apartment in July and get married in September. My and my potential wife gross income fits that limitations for tax credit. Will we be eligible for that or we must be married before buying home in order to be eligible?

If two individuals purchase a home and file their taxes separately, they would each be eligible for $4,000 of the tax credit, to a maximum of $8,000.

It sounds like it might be advantageous for you to file your 2009 taxes as a married couple as this would most likely maximize your tax credit. As a married couple you would qualify for $8,000 tax credit. But this is a question for the tax experts. Give them a call after April 15th and they will be more than happy to sort it all out.

Keep in mind there are other rules including income eligibility, etc.
