Realtor not doing their job

What do you do when you have a realtor who is not doing their job and your one week away from closing?  I have to leave numerous messages with the realtor to try to get a hold of them.  From my understanding a realtor should be assisting you with the process and my realtor has hardly done anything I'm running around trying to figure out everything on my own.  I guess the realtor feels that there's nothing I can do and I'm stuck with her.

Vin,

I would recommend contacting the Agent's broker and a Real estate attorney.  If the realtor is failing to perform their duties, you may have cause to end the contract with the realtor or have the broker reduce the agent's commission percentage.

The agents are referring to the managing broker of the agency with which your agent is affiliated. Even though agents are independent contractors, they generally still basically have a "boss" and that is who the agents are referring to. Good luck.

Thanks I just spoke with the broker.  He said he would encourage my realtor to call me and work it out.

How sad is it when your own realtor won't answer your calls with less than a week left to close.

Ouch,  it sounds like the broker blew you off.  Do you feel the same way?  If so, you can see where the realtor gets it from.  If you dont hear from the agent in the next couple hours, call the broker back and let them know you will be contacting your attorney.  Advise them you intend to cancel the contract with the realtor and the real estate company on the grounds they are not performing as agreed and have failed to uphold their end of the agreement.  This should light a fire under their rear ends.  I would definitely demand a reduction of the agent's commission if this is a sale or demand that a portion of the realtors commission be credited towards your closing costs if this is a purchase.

If you are unhappy and getting no response, I would call the realtors broker.  The broker should help getting this person back on the playing field.

Before giving advice, have the respect to actually read the posts...

What particularly do you need the realtor to do? I mean, in what specific way is your realtor letting you down?

If you feel abandoned and have questions that you agent refuses to answer because they refuse to pick up the phone, call the local real estate board and ask if you have grounds for a complaint. You may have the option of not paying the commission at close of escrow. In my state, the neutral title company will be happy to hold your agents commission in escrow. You can call your title company and ask them if they will hold a portion of your agents commission pending the resolution of the RE board complaint. If the answer is yes from the board and the title company, call the broker back and explain that their agent has abandoned you and that you intentd not to pay them when the house closes. I venture to guess that in 24 hours your phone will mysteriously ring with a call from your agent.

I would only consider doing this if you truly feel that your agent is taking advantage of the situation and not providing the professional service tht they agreed to in the contract. Often as long as this type of agent feels that they will get paid anyway, they blow you off through close of escrow. The prospect of not getting paid tends to bring them back into the loop. I am sorry that your agent and their broker has chosen not to resolve this. Please explore your options and stand up for yourself if you are being mistreated by your agent.

I second Roberto's question as to what exactly the Realtor is doing or not doing that you are unhappy with. Is it something a loan officer should be taking care of, for example how much to bring to closing? If not, in addition to calling the broker and agent, I would email both of them. It leaves a paper(less) trail if you should ever need it. Good luck and I'm sorry you feel so let down.

I agree that paper trail is priceless. If you intend to file a complaint, you will need it to support your case. A phone call won't mean much to the board. If you intend to file a complaint, keep everything on paper and stop answering your phone for the agent/broker to avoid misunderstandings.

You do need to be honest with yourself about why you are dissatisfied with your agent and about whether their actions fall into the "irritating not very nice category" or the "truly unprofessional" category. If they don't cross the line to unprofessional, I would make sure an give them the appropriate word of mouth that they earned by dumping you at the escrow line, but don't waste your time with a complaint. Life is too short.

Thanks for the advice I'm not going to go to the extreme with it because I was able to successfully manage everything on my own.  There were seperate agreements in place outside the contract that the realtor agreed to handle, the agreements were outside the contract because the seller wouldn't agree otherwise.  Though I'm not getting everything I want I'm willing to make small sacrifices to get this over and done with.  I definitely won't be recommending her.  On another note.  I found my mortgage broker and home inspector right here on zillow and they were the best. I'm thankful for that and I will highly recommend them.  I wish I found my buy side agent here as well oh well next time.

let everyone know that you were unhappy with your agent. Agents who last in the business do so based on building solid relationships. When the question comes up kindly let everyone know that your agent did not do her job. If you are that close to closing there is probably going to be very little you can do. Contacting the managing broker might get the agent to call you back. But, ultimately you can't have them not get paid at this point, and a complaint for poor service in some parts will fall by the way side if the transaction did make it to a satisfactory close. But, Not recommending a bad agent, and being vocal about poor service to others will get results.

Yeah read the thread besides ethics complaints are a massive waste of time. The boards are staffed by realtors who are often associates of the bad agent. Agents protect their own spawn. Your agent would have to be high on drugs and stab you for you to get any satisfaction from the board. Bad word of mouth is more effective as a punishment.

yea the best advice, contact the manager or broker of record. and if that doesnt work, contact the sellers or buyers attorney for information.  for the most part after the attorney review process and all inspections are completed, your attorney should be your second guy or gal to contact if something like this happens, good luck

FYI - my broker is on one of the committees and he doesn't give anybody a break. And I don't protect my own if they are wrong b/c like many Realtors, I respect the profession and try to do what's in my clients' best interest. Sorry... but after getting slammed so much, I have to stick up for the good, honest and hard-working agents. There are a few of us out there! :)
