I have a bigger question for you. Why should anyone not be payed overtime when the company is keeping them away from their family or personal time? Why and how is it legal for John/Jane Doe to work one minute for free for a company? So if they make a mistake at 40 hours and one minute, not compensated, how can a company discipline or terminate an emplyoee who is working for free? I view overtime as a reward to the employee for spending extra time working on the companies behalf and a punishment for the company not having enough labor to complete the tasks in the required amount of time. The solution is to hire more labor, make your current labor more efficient or pay the overtime!
