you do not have to refinance with your current lender, although if your current loan has pmi, the ltv may be limited on your new loan. mha rates can be a little higher depending on your circumstance (credit score and ltv for example will influence the rate and/or fees). also, a 15 year loan is going to cost less, because you will not be subject to loan level price adjustments that apply to a 30 year fixed.

I contacted another bank and was told that under the MHA / HARP / Freddie Mac program I can only refinance with my current lender - Bank of America - for anything above 95% of the home value.. I have searched the gov't website for the MHA program and cannot find anything about this.

One of my branch employees is a licensed Florida LO and she told me your scenario is coming up with 4.00% with NO POINTS.
She says there are some lenders that are pricing out with 4.0% and almost 3 points, but Flagship Mortgage has a source of this that is pricing out as described above.
