Yes, you can refinance just have the attorney's set up two seperate rooms or have your ex come at a seperate time to sign off on the deed of trust. The decree should enforce her participation.Happy Holiday's
Joseph,Because your ex has already executed a quit claim deed she will have nothing to do with your new re-finance.
Your existing lender does not require any paperwork, authorization, or anything else in order to accept payment in full from the new lender. They don't care who the payment comes from, they just want their money.
Your new lender will only require to see the quit claim deed if your ex spouse is still showing on the title to the property (which means you never recorded the quit claim deed executed though the divorce); you will simply need to provide that document to the escrow/title company.In no way, shape, or form will your ex need to be contacted regarding this loan.Please let me know if you have any additional questions.Troy Ormnode
FYI - with the signed deed from your ex you are now the sole owner and are free to do anything you want with the property. The only way to get her name off of the existing loan documents is for you to refiance the loan and remove the old documents and put on new loan documents with only your name. I'm assuming that you want to refinance because the rates are so low.... The new refi loan will erase your ex's name for good. Go get it done . . .n othing should hold you back . . it's full speed ahead . .R
