Rent limits in Low Income Housing Tax Credit properties

I read that rent limits for each unit is established so that tenant monthly housing costs, including a utility allowance, do not exceed the applicable LIHTC rent limit. So if we qualify at 40% MFI but pay rent at the 50%, isn't that out of compliance with the code?
