San Francisco Foreclosure

Hi,

My roommate and I just moved into a 3 unit apartment complex last month in Inner Sunset San Francisco. Today we found a notice that the property is being foreclosed on and being auctioned at the beginning of next month. We have a month to month lease. What our our rights as renters? Should we worry about being evicted?

The Federal "Protecting Tenants at Foreclosure Act of 2009" gives you some rights.  Month-to-month tenants are entitled to 90 days' notice before having to move out.

If the buyer  intends to live on the property -- this buyer may terminate a lease with 90 days' notice. Importantly, the law provides that any state legislation that is more generous to tenants will not be preempted by the federal law.    You can look up california landlord/tenant guides here.
