Sellers signed to provide us (Buyers) $5000 at Closing and haven't paid full amount.We closed last week, 7/31 after an arduous process of having to deal with the IRS to get tax transcripts which delayed us 10 days over our original closing date (7/21). At closing, our fees on the HUD only totaled $4529 that were to be paid for by the sellers. However, we signed a contract that promised us $5000 at closing by the sellers, not just for closing fees, but as a bonus to the buyers for closing which could go to whatever we desired. They promised to our realtor and their relator that they would bring a $471 check to our title company if we signed, however they decided not to do so. Who is liable for ensuring this debt is paid based on our contracted agreement at the time we decided to purchase the home? The $5000 is well below the 3% marker of the allowable amount for the sellers to pay, so how is it that we can recover this relatively small, but well deserved amount?
