Square footage discrepancies

I am in contract on a resale house. The current owner has bought it from a builder. The square footage on the bank's appraisal is approx 100 less than the MLS listing; and the square footage according to the blueprint of the builder again is 100 less than the bank's appraisal. However, the bank appraised the home up to the sale price that was negotiated in the contract. Now, I am concerned that nearly 200 square footage difference is a big deal. The seller's agent is not willing to negotiate with us, as the option period is already over and he claims that in the MLS listing he has mentioned the source of the square footage correctly (which is tax records). It looks like I may lose totally up to 3.5 K (option money, earnest money, lender fee including appraisal, inspection, etc), if I back out. Is it possible at least to get the earnest money (2K) back?

Square footage can be measured several ways and no two will be the same. There is liveable sq footage and structural sq footage. Consider you are buying the house and not just the interior part. The county has a number for tax purposes, the appraiser for loan purposes and the builder for construction purposes. You are buying for living purposes. If you were happy with it when you made your offer, it should not matter since the house has not shrunk.

I agree with John. You were happy with the size until you knew it was less. That's like saying "Oooooh, I want a popsicle!", then being mad because you didn't know there was ice cream.

I believe the tax record is the appropriate method. If the bank and mortgage company think it's less, let them. IT's to your favor to have them do the comps and calcs on less sq'. They will say 1200sq' at 130/sq' and get a lower number. That means lower taxes, etc.

  How big is the home living space?  If it was say 2400 sq ft, a 200 sq ft difference might not mean much. But if it was 800 sq ft, then the 200 sq ft would be 1/4.

  Depend on how much you still like the place and if you and your family would be comfortable living there in the beginning, you might want to move forward and add additional sq ft later.
