I am being told by the real estate agent and the lender that the buyer cannot be present during the appraisal - is that a lie or is it true?  they state new litigation was passed on this?  I can't find any

Are you confusing the appraisal and the inspection?  The buyer wants to be present at the inspection.

Question:  why would the buyer want to be present during the appraisal? Sometimes, the appraisal is just a drive by.  You may never even see the appraiser.
The appraisal is not for the buyer but for the lender.  The lender wants to be sure the house is worth the loan they will be making.  If the house comes in "under value" the lender will not make the loan.  If the appraisal comes in above value, then the lender will loan out the money.
