I am not sure I understand your question, but I do not think there is a connection between the two. If you are not paying your dues and/or the court procedure is about the dues/foreclosure you can still try to get a deed in lieu. They are separate issues, but you need to be talking with an attorney as these are legal issues.

We are going to court soon and the association is sueing us. Can we still do a lien of deed
