I believe you can just claim the property from them. Under the edit button, it will say "claim listing". You will have to "prove" you are the listing agent, by selecting the correct seller's name, but you won't have to involve your broker. You will then be able to remove all of the previous agent's pictures and description, and supply your own.

I would approach the previous agent directly. If that did not work, I would have my broker contact their broker. If that fails, then I would contact the MLS board and ask that they get involved by contacting them.

I would suggest contacting the agent and tell him/her that the listing is still active under him/her and that they need to remove the listing from the source. The source of the listing will help you locate where this listing is coming from either via broker feed or syndication service(navigate the home details page then look for the listing source info).
