I agree with James, you never rent to someone without receiving the full month's rent. If there is an agreement on the deposit always use an addendum and have them sign and date it. Have EVERYTHING in writing though. If your tenant has not paid rent per the terms of the lease agreement then they have broken the terms of the lease and you can proceed with an eviction. However, you need to do the steps to evict correctly. Serve them a 3 day pay or quit. Certify mail it and if you can post it on their front door. If no response within 3 days then serve the 30 day to get them out of there. Keep your pictures of the move in inspection which shows the condition of the property at move in versus the condition of it now. Keep their applications, credit checks, copies of ID along with lease for the eviction process. If you have any email or text correspondences keep those as well. NEVER delete them. Lastly, please consult an attorney as soon as possible. This is just from my prior experiences. Time is on their side and not yours.

You NEVER rent to someone who rush to get it b/c they are probably got evicted or something bad happened to them. Take time and do all credit check, criminal, background, call the 2 previous landlords, visit they current resident to see how they live. Always take time to screen for good tenants as eviction is costly and time consuming. Did you try to talk to them and see what happened. But file 3 day notice now b/c u want to start eviction process now. Yes use an attorney for this. Unfortunately this is part of learning. Even sometimes we do the best screening we can there is always a chance of problematic tenant.

The most important thing is to act fast. It is never pleasent to evict some one, however, I always that 'you are not running a charity'. First and foremost, file a 3 day notice to pay or quit. (I have a copy of this form you can use if you need.) If rent is not paid, then proceed with the eviction process - I recommend using a lawyer for this. Are you still in Victorville or close anyway? I would go by the house if you could. Like I said before I definately would file the 3 day pay or quit. You can look online how to do it or there are companies in Victorville who will do it for you. If you do it yourself take a picture of it so you have some proof it was delivered. You should be ok with the items you left in the house as if they did not pay for them, and they take or sell them, you could file a police report. Of course if they gave you a fake SS number then chances are they will have not problem stealing from you.
Again I think you bet best at this point would be to talk to an eviction service and see what they have to say. If you have to a lawyer may be a good bet too but you are starting to add up some big money about that time.
I know it sucks but you have to go after them now as fast as you can. If they have already broken your agreement it will not get better later. The best you can do now is to try and make the best of a bad situation.

thanks for your response... i did run a credit check but there was something fishy about it. the ss# they gave me said there arent any credit, but she gave us a copy of her credit report but seemed like nothing matched. they were rushing us so we just said ok... my big mistake.
what about the things they said they were gonna buy? is that a lose also? im gonna try to get something at least for the items they said they are going to buy. should i wait and try calling with another number?

Well looks like I know where my renters went on my rental house in Victorville.
You are not going to like this answer but basically you screwed up. You should have gotten all of that before they ever set foot in the house. Not trying to poke fun at you but about all you can do now is try and cut your losses. First you need to file a 3 day pay or quit to get the ball rolling. You can look online to see just what you need to do. Chances are that won't do much but it may get them out. From that point you are better off just hiring someone to evict them. I am guessing that they got in and know the laws better than you do.
I guess my question for you is did you run a credit check? It also helps if you have their social security numbers too. To not make you feel too bad I did not run a credit check either and it burned me in the end. You may get lucky and they will just pay late. I know my renters paid late probably 10 of the last 12 months. I always got my money but had to work for it every month. Beings as they already burned you I would just get rid of them as soon as I could at this point as it is not going to get any better.

What do I do if the tenant hasn't paid the first month's rent and full deposit?
i just rented out a house in victorville, ca sometime on oct. 25th. they wanted to move in asap so we moved out early for them. we left the tv, frig, washer and dryer that they said they were going to buy from us. we only recieved a portion of the deposit and havent recieved the first month's rent, rest of the deposit and for the items they said they were gonna pay for. how am i suppose to handle this situation? thank you for your time....
