What do I need to amend the date on a Real Estate Contract?

I have a contract that expires on November 15, 2013 and need to change it to January 31, 2014. I just want to be sure that I do it right.

Your agent has to prepare an addendum to the contract which you sign and the sellers sign.  The closing date will also have to be changed.

At the time we thought the date was OK because I had a 1099 stating September 27th was the date the bank took it back. But it is not until FHA pays it off that the three year timeframe starts. My lender and I had no way of knowing that until the Caviers program is used. The owners are working with us because they understand that we had no way of knowing when FHA paid it off. I just want to be sure that I do correctly for the amendment of the REC.

When you entered into this contract, did you make the seller aware that you weren't financeable until January 2014?  

You can extend your closing and mortgage commitment date as long as all parties are in agreement and do it in writing.  

I am surprised that your agent and the agent for the seller isn't displeased that you entered into a contract that you couldn't perform to.

OK, so you are wanting to delay the closing until January 2014. I would imagine the seller will not be over joyed to hear that and you could get some negative reply. If they thought you were close to closing and now are asking them to wait until January be ready to hear a NO. Good luck.

It's not a short sale - right??

We are purchasing a house under a Real Estate Contract that expires on November 15, 2013 for the financing. We need to extend the expiration date to January 31, 2014 to get past the three year FHA requirement due to our previous foreclosure. I will contact our realtor about it. Thanks for the advice.

You still confuse me. Expiration of the contract -- to buy or sell? Are you talking about the listing agreement expiration date? If so, again, the Realtor will do it.

If that is not it explain better what you are asking.

Your Realtor will do it. Is there a contingency that is expiring or what? It's not a short sale is it? Putting dates on those can be a waste of time.
