What is the best way for her to receive modification?

My mother currently has separated from her husband unofficially. She would like to keep her current home. What is the best way for her to receive modification? Does her husband have to deed the house to her? Does she have to have legal separation papers to qualify for a modification

This may all need to be resolved in the divorce settlement or legal separation at first, and she should consult an attorney before doing anything.  If her husband is in agreement to let her keep the property as her sole and separate, then he may be able to deed his interest to her.  However, I would question whether or not your mother can qualify for the house on her own.  You may wish to consult a qualified mortgage Broker first and have him/her review her financial situation.  She may be able to refinance instead of modify.  Loan modifications aren't as transparent when it comes to guidelines used in qualifying, and if she decides to go this route, I would recommend that she consults with a HUD Certified Counselor or a reputable company who is experienced in modifications.
